Attorney, Domestic Violence Clinic
Duties: Reports to Faculty Director, Domestic Violence Clinic. Under the supervision of a licensed attorney (the Clinic Supervisor), represent clients as part of their coursework. Handles cases when the students are not in session. Reports to the Faculty Director and will be mentored by the Clinic Supervisor. As part of the Domestic Violence Clinic, represent and provide legal counsel. Coordinate, mentor, and train student volunteers. Provide legal advice and representation to UO student survivors in emergency matters related to domestic violence, sexual assault, and stalking cases (e.g., obtain restraining orders and advise survivors of their rights as victims of crime) to further the survivor’s immediate health and safety. Emergency legal representation could extend to other matters, such as emergency family law matters (e.g., an emergency order prohibiting the child from removal from the jurisdiction in cases of likely child abduction), representing the survivor on issues related to housing (e.g., when the survivor wants out of the lease or to needs to remove the perpetrator from the lease) and employment (e.g., to ensure the victim obtains the time off needed to attend the restraining order hearing and participate in the criminal justice proceedings) as well as reminding employers and landlords of survivors’ statutory privacy rights. Also provide “special services” to assist victims with managing practical problems created by the victimization when there is a legal component and it is related to survivors’ immediate health and safety or would further the survivor’s participation in criminal justice proceedings. Such matters would include representing the victim in the student conduct proceedings brought against the perpetrator. Provide emergency legal advice and representation to low-income non-University survivors in domestic violence, sexual assault, and stalking cases to further the survivor’s immediate health and safety. Legal action would typically include representation on restraining order matters, but could extend to obtaining other emergency legal relief for the survivor, such as emergency financial support when not available through the restraining order hearing (alimony pendente lite or child support), an emergency pick-up order when the abuser has custody of the child, an emergency order prohibiting the child from removal from the jurisdiction in cases of likely child abduction, etc. Short of legal action, emergency legal services could include representing the survivor on issues related to housing (e.g., when the survivor wants out of the lease or to needs to remove the perpetrator from the lease) and employment (e.g., to ensure the victim obtains the time off needed to attend the restraining order hearing and participate in the criminal justice proceedings) as well as reminding employers and landlords of survivors’ statutory privacy rights.
