Job Overview

A law firm seeks a Pre-Litigation Lawyer to join its growing personal injury team in Wilmington, DE. This role provides legal oversight, strategic direction, and risk assessment during the early stages of case development. The ideal candidate holds an active Delaware Bar license and possesses strong skills in legal analysis, strategic decision-making, and client advocacy to maximize client outcomes.

Duties

• Manage an assigned caseload by providing legal strategy and oversight throughout the discovery phase, evaluating liability, damages, and insurance coverage.



• Provide legal guidance to support staff regarding case strategy, documentation, evidence collection, and next steps to ensure comprehensive case preparation.



• Review insurance policies, coverage issues, UM/UIM claims, and liens to determine overall case value and identify opportunities for early resolution.



• Monitor medical treatment progression and evaluate whether cases are appropriately positioned for demand, negotiation, or transition to litigation.



• Communicate with clients who request attorney contact within 24 hours, providing legal guidance and maintaining exceptional client service standards.



• Identify deficiencies in liability evidence, damages documentation, or insurance information and direct corrective action to strengthen case posture.



• Partner with team leadership and cross-functional teams to improve legal strategies, workflows, and overall case outcomes.

Requirements

• Experience practicing personal injury law in pre-litigation, litigation, insurance defense, or claims strategy roles.



• Excellent negotiation, communication, and client relationship skills with a focus on achieving the best possible outcomes.



• Strong knowledge of personal injury law, insurance coverage, liability, damages, liens, and UM/UIM claims.



• Excellent written and verbal communication abilities to effectively advise clients and collaborate with internal teams.

Education

• Juris Doctor (JD) from an accredited law school.

Certifications

• Active license and membership in the Delaware Bar, in good standing.

Skills

• Strategic decision-making and risk assessment during early case development.



• Ability to determine when matters should transition to litigation and provide strategic recommendations regarding timing.



• Monitoring of statutes of limitation and other critical legal deadlines to ensure compliance.
