Director of Privacy & Legal Compliance
Responsibilities: Design, establish, maintain and lead global privacy program, from design to internal and external communications, training, breach management processes and audits. Serve as the company’s Data Protection Officer/Privacy Officer and, as necessary or appropriate, participate in representation of the company before data protection authorities and other regulators and agencies. Maintain an up-to-date understanding of domestic and international data protection, serve as the subject matter expert privacy and data protection matters, management, practices and processes, covering domestic and global privacy, data protection and compliance standards (including HIPAA/HITECH, GDPR, Privacy Shield, PIPEDA, etc.) to ensure policies and practices meet legal requirements and operational risk tolerances. Conduct privacy impact and risk assessments and data protection impact assessments on internal functions, features, strategic partners and vendors/third parties. Draft, update, monitor and assess company’s privacy notices, internal privacy policies, data handling policies and procedures, Data Processing Agreements, addenda and policies, data security exhibits and other documentation as applicable. Advise on privacy issues related to new products, new features and services. Assist Corporate Security in audit and framework compliance tasks and projects, including SOC Type 2 and ISO 27001, as well as the completion of security assessments and questionnaires. Manage registrations and filings with applicable data protection authorities and/or agencies, privacy certifications with private auditors (TrustArc Privacy Shield Seal and APEC Controller/Processor Seals) and any vendors (privacy management tools). Maintain current knowledge of applicable federal and state compliance laws and regulations. Lead and provide oversight of legal compliance efforts to ensure effectiveness. Support M&A efforts through due diligence and ongoing efforts regarding privacy and global compliance after acquisitions and through integration. Lead and participate in interdisciplinary work groups to provide privacy and compliance guidance for initiatives. Review and assist with the negotiation of privacy and security exhibits, business associate agreements, compliance documentation and any other applicable documentation as needed. Serve as liaison with senior management and ELT regarding privacy and compliance matters.
